The Legal Distinction: Private Association vs Retail Shop
Purpose and Membership in a Private Club
💡 In plain English: A private non-profit association is based on membership, not walk-in retail access.A private non-profit association differs from a retail shop open to the general public in its purpose, organisation and relationship with its members. Joining a Cannabis Social Club (CSC) establishes an internal membership relationship under the club's statutes, not a walk-in commercial transaction. Membership does not, by itself, confer a right to be supplied with cannabis.
💡 In plain English: Membership does not grant automatic commercial access rights.Article 22 of the Spanish Constitution protects freedom of association, but does not provide blanket immunity for cannabis commercialization. Activities remain subject to applicable law, including Article 368 of the Spanish Criminal Code. Supreme Court case law restricts non-punishable shared consumption to small, identified groups of habitual users in enclosed private locations, with small quantities for immediate and exclusive consumption and no supply to third parties. Each case must be assessed individually.
Educational information, not individualised legal advice. Private status or membership does not constitute general authorisation to cultivate or distribute cannabis. The club decides on admission in person under its statutes; a pre-registration pass or reception priority does not guarantee admission.
